Recent Success in Arizona Family Law
In September 2024, we had the privilege of assisting a mother through an incredibly challenging custody battle. She had retained Simon Law Group (SLG) 14 months prior, after her previous attorney could no longer handle the relentless litigation from the father.
Why Simon Law Group?
Why did she choose us? Because at Simon Law Group, we have a wealth of experience in representing parents in high-conflict cases. The father had filed over 100 pleadings in the past three years, making the situation exceptionally complex and stressful.
Most recently, the father filed an Amended Petition for an Order to Show Cause, citing violations of legal decision-making and parenting time orders. In response, the mother didn't back down. She filed a Counter Petition to Modify Break/Vacation Regular Parenting Time, seeking a more balanced schedule.
Success at the Hearing
After an extensive evidentiary hearing, the Court denied the father's requests and ruled in favor of our client. The new parenting schedule was set to a week-on/week-off arrangement, which better suited the needs of the family. Additionally, the Court mandated that the father enroll in and complete a High Conflict parenting class.
One of the standout points in this case was the Court's decision to award attorney fees to the mother. This was due to the father's frequent and often unnecessary filings, his attempts to relitigate issues that had already been decided, and petitions that lacked credible evidence.
